NYAPRS Note: Once again, the federal Department of Justice has demonstrated its strong commitment to support the ADA and Olmstead related rights of people with disabilities to live and work in the most integrated setting by joining a lawsuit against a state whose response has been deemed inadequate. Several years ago, DOJ did the same here in New York when it joined the suit pressed by Disability Advocates, the Bazelon Center and their partners against our state’s policy of confining thousands of New Yorkers with psychiatric disabilities in adult homes.
Speaking of that effort, this year’s budget agreement includes $16.8 million “For services and expenses associated with the provision of education, assessments, training, in-reach, care coordination, supported housing and the services needed by mentally ill residents of adult homes, which were identified in the 2009 federal district court case Disability Advocates, Inc. v. Paterson provided, however, no funds from this appropriation shall be
used to pay for the services of a monitor appointed by such district court.”
