During this session we will cover the federal law and provide a sampling of the state law regarding service animals and assistance / emotional support animals in public settings, housing, and transportation. Service animal types and training will be reviewed for context. The choice of law issues will be the focus, though — the difference in definition under the ADA, FHA, and the ACAA. Special emphasis will be given to clarify the different regulatory approaches under the DOJ, DOT and HUD regulations, as well as state law approaches that protect a wider array of animals and users and provide penalties unavailable under federal law. The session will involve review of legislation, regulations, guidance, case law and recent news items regarding service animals and claimed service animals.
