As you’ve heard, President Biden and Members of Congress are negotiating the Build Back Better Act. We are reaching out to you because you live in a state with a Democratic Senator involved in negotiating this package and we need your help to ensure that a critical mental health and substance use treatment provision is included: parity enforcement.
Despite the Mental Health Parity and Addiction Equity Act prohibiting discrimination against mental health and substance use treatment coverage, health plans continue to violate the law. Yet, the U.S. Department of Labor, which enforces parity for over 100 million Americans, cannot fine insurers for violations. To deter parity violations before they occur, the Department of Labor must have an enforcement mechanism.
